Corrections
Descriptions of goods and services included in the Artsability site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should know that the colours and appearance of images, will vary from the way they appear on the screen. as each picture is painted by hand to order. In the production of canvas artworks you acknowledge that there will be a certain amount of cropping and editing to create the best possible result from the image or artwork.
Copyright
All copyright, trademarks and other intellectual property rights in and relating to Artsability are vested in Artsability or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. All copyright and intellectual property rights existing in our designs and products and in the content of the site are and will remain the property of us. Any designs where a third party has be credited with copyright will remain property of the third party with all rights reserved. By your use of the Site and agreement to the Terms, you agree that you are the copyright owner, or that you have express written permission from the copyright owner, for any images you supply to us. We reserve the right to refuse any images that we are unable to reprint for legal reasons. We reserve the right to use any images you supply to us for Photo to Canvas or other services for promotional purposes.
Cancellations
Should you wish to cancel any order after making payment, cancellation can only be made via the standard refund process as per sale. A fee of £5 will be charged to cover Paypal fees. You cannot cancel after 3 days- you will have to go through returned's and its terms. If you cancel payment with your card provider rather than following our refund policy, you will be liable for fee that provider charges us. Charge backs will be thoroughly investigated and if necessary, will referred to relevant investigative or law enforcement agencies.
Returns
You must tell us in writing, or in another durable medium, if you want to cancel. This includes letter, or email. If the goods delivered are faulty or have been damaged in transit, then we will either exchange the goods, or give you a full refund minus delivery costs +25%, providing the goods are returned to us within 7 working days from the date of delivery. Carriers NO LONGER INSURE WORKS OF ART, which means no claims.
If the item ordered is not to taste and an exchange is required, this can be provided but a delivery charge at our standard rate will be incurred. If you wish to exchange the item for an alternative one, please contact us to ensure that the item you require is available. For your protection we strongly recommend that you use a recorded delivery service to return goods. Proof of posting is not proof of receipt and all goods remain the responsibility of the customer until they are received by us. All goods must be in their original condition and with all packaging intact, as we cannot exchange used goods. Due to the delicate nature of art, canvas panels must be wrapped individually, as provided, to prevent scratching. Following receipt of returned goods as set out above, refunds will be processed within 45-180 days 25% less total to cover Artists labour and material. Refunds will be credited via the original purchaser's payment method. You will forfeit your guarantee and refund if you make a Paypal cashback claim. These Terms do not affect your statutory rights. Loss
we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused.
Delivery
We aim to despatch goods within 7-10 working days from receipt of your payment, from despatch. However we may not be able to provide an exact delivery date or time of day. International orders may take 2 working days from date of despatch to be delivered. All deliveries are sent via an insured, secure courier service. Please ensure that someone is available at your delivery address to accept the goods, as a signature is normally required. Note that Artsability does not charge customs duties on International shipments outside of the EU. If any additional customs charges are incurred during your shipment, they are not calculated or monitored by us nor are they the responsibility of Artsability. We recommend that you check with your local customs officials or post centre for more information regarding importation taxes/duties that may be applicable to your online order with us. Orders are shipped and delivered Monday – Friday. Delivery times are estimates only and include working days, Monday - Friday, not weekends or public holidays.
